I think this Judge has, in my mind, allowed a personal feeling to sway his judicial decision on this case.

I think that this particular Judge needs to provide evidential proof for his comments on what James Madison actually intended when he wrote/included the Second Amendment.

If he cannot provide the evidential proof, then his decision must be overturned due to a lack of proof.

Good luck guys...the ANTIs appear to have gained ground on this one.

Cheers, Vince

Second Amendment says;
A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.

The Justice says;
He suggested that those values and intentions mean that the Second Amendment allows for restrictions on the individual, including an all-out ban on handguns in the nation's capital.

"The difficult job in open cases where there is no clear answer is to take those values in this document, which all Americans hold, which do not change, and to apply them to a world that is ever changing," Breyer said. "It's not a matter of policy. It is a matter of what those framers intended."

REALLY? That man needs a new job! He's been mistakenly appointed to a job that he doesn't qualify for. The Second Amendment is not something that gets updated as time permits, it's a stated fact of life. It's a matter of policy. It's also an important check on Federal power. Is Breyer saying that judges, including the Supreme Court, can ignore rights specifically guaranteed in the Constitution based upon the motivation for their inclusion? That judges can decide explicit rights don’t exist because they weren’t included in good faith? REALLY?

He needs a new job.....in Haiti

I know that I'm preaching to the choir but...

James Madison said:

"Do not separate text from historical background. If you do, you will have perverted and subverted the Constitution, which can only end in a distorted, bastardized form of illegitimate government."

"The Constitution preserves the advantage of being armed which Americans possess over the people of almost every other nation where the governments are afraid to trust the people with arms."

George Washington's address to the second session of the First U.S. Congress:

"Firearms stand next in importance to the Constitution itself. They are the American people's liberty, teeth and keystone under independence. The church, the plow, the prairie wagon and citizens' firearms are indelibly related. From the hour the pilgrims landed to the present day, events, occurrences and tendencies prove that, to ensure peace, security and happiness, the rifle and pistol are equally indispensable. Every corner of this land knows firearms, and more than 99 and 99/100 percent of them by their silence indicate that they are in safe and sane hands. The very atmosphere of firearms anywhere and everywhere restrains evil influence. They deserve a place of honor with all that's good. When firearms go, all goes. We need them every hour."

Well, I seem to have goofed. Another website that I looked at says that the George Washington quote is bogus. I'll look into it more.
