A real shame, there are numerous states that I would not consider residing in, New Jersey is one of them.

Unfortunately the judge is a human with his own prejudice.
Reading this story make me seethe inside,
because the law there is exactly as it is in this beautiful land of OZ I live in.
As gun owners, we are all guilty until proven innocent.

AMEN Gelan...I feel exactly the same way...I am furious with this decision, not because I think the guy was treated wrongly, but because it is obvious the Judge is an ANTI and manipulated the law and court proceedings to achieve his desired outcome!!!
I think that this guy has a very strong case for appeal to the Federal Court, citing the Federal Law, and having all of his costs picked up by the State on acquittal (which I can see as the only honest and fair result).

Yes Marty...maybe she should feel bad that she has "put him in" to the Police...but then again mate...put yourself in her boots...she felt that he presented a danger to himself...what would you do?
I am a Justice of the Peace here in Queensland and part of my responsibilities falls under the Mental Health Act. I have seen first hand, on two occasions, the anguish and fear a parent goes through when they genuinely believe that their child may self harm. In fact, I ordered a teenager to be examined by a Dr or Mental Health Practitioner for this very reason only a week ago. The Police were also involved. There are times when it just has to be done for the sake of the person involved. When it involves a parent and a child, I call it "tough love". Its not an easy decision to make though...so I don't blame the Mother for doing what she did...she feared for her son's safety and life.

It is true that I don't know the circumstances or the resources available to her. I would hope that the family had already exhuasted all other means of hepling the son get his head together - intervention by family and friends, psychological counseling, etc. etc.
The way I read the article somehow makes me think that the mother acted out of naivete rather than desperation. I could very well be wrong there.
The New Jersey Sate Police, though? Lucky he returned home. No matter what his state of mind, I would think they would be more of a threat to him than he could be to himself, even if he was standing on a bridge railing and considering jumping.

And there you have it.............American justice at it's finest !!!
This is the kind of results you get when you allow bias on the bench and get rid of constitutional law. I'm just wondering if they had to release a hardened criminal on parole (for good behavior of course) to make room for this guy ???

I have been following this story and I cannot believe the ignorance of the law, the judge (now no longer involved as he was taken off the case) makes you wonder when the time will come where we decide when enough is enough.
I'm sure his mom is thinking twice about this but now there is talk about having Gov Christy pardon or exonerate him.??
Did this really have to go this far? I don't think so.

Just putting a different spin on it.
Surely a miscarriage of justice appeal would be appropriate, I don't know how its done over there but it seems overbearing by the police, search and seizure without warrant or good cause to suspect?
In NZ we do have certain statutory powers but to use these we gotta cross the t's and dot the i's and be prepared to back ourselves up in court to provide the good cause.
You sure do things different in each state of the USA which also confuses situations.

In the USofA we submit to unlawful searches all the time.
We do it in the name of "war on drugs", airport security, and "national safety".
There is no reason to search me when I go to a ball game, or fly to see my kids in the same state, or driving down the road.
Too many people submit to search in the name of cooperation. I don't go to ball games or concerts. I have given up flying and if I get pulled over and a law enforcement officer wants to see whats in my trunk I tell him he needs a warrant. I will even agree to wait while he gets one if he will place me under arrest. I haven't been in jail yet so I guess I am not pushing too hard.
